It sounded like free money.

A representative from a company offering a "Homeowner Benefit Program" knocks on your door or calls your phone. The pitch is simple:"We’ll give you a check for $1,200 today. It’s not a loan. You never make monthly payments. All you agree to do is use our brokerage if you ever decide to sell your house in the future. If you never sell, you never pay us a dime."

You need to pay for car repairs or groceries, so you sign the paperwork and deposit the check.

Years pass. You decide to refinance your mortgage or sell your home with a trusted local real estate agent.

Your title company calls you with shocking news: your closing is frozen.

A company called MV Realty recorded a formal lien against your property deed. Buried in the fine print was a 40-year exclusive listing covenant that runs with the land, binding your home until the year 2064.

To release the lien and close your refinance, the company demands an "early termination fee" equal to 3% of your entire property’s market value—a staggering $11,400.

You didn't get free cash. You walked into a predatory 40-year listing trap.

What Are NTRAPS?

In the real estate and legal world, these agreements are known as Non-Title Record Agreements for Personal Services (NTRAPS).

A standard real estate listing agreement lasts 3 to 6 months. It is a personal contract between you and an agent. It cannot encumber your property, and it ends automatically if you pass away.

NTRAPS turn that upside down:

  • They last 40 years.
  • They bind your children, heirs, and estate beneficiaries.
  • They are secretly recorded in county deed registries, creating a legal cloud that blocks refinances, home sales, and equity transfers until you pay thousands in extortionate fees.

The Nationwide Crackdown

Over the past two years, state attorneys general across the country took aggressive legal action:

  • State Attorneys General in California, Pennsylvania, Colorado, Nevada, Florida, Massachusetts, and Ohio sued to halt the practice.
  • Courts have declared these agreements deceptive and void from inception, ordering the release of thousands of recorded liens.
  • Over 30 states have passed new laws making 40-year listing agreements illegal and unenforceable.

However, if you signed one of these agreements, the lien may still be sitting on your deed right now, waiting to derail your future sale or refinance.

3 Steps to Clear Your Deed

  1. Search Your County Land Records: Check your local county register of deeds online portal for any "Memorandum of Agreement" recorded under your name.
  2. Demand a Formal Release: If a memorandum appears on your deed, file a demand letter under your state Attorney General's consent decree to have the company record a formal Release of Lien.
  3. Consult a Real Estate Attorney: If the company fails to record a release, an attorney can utilize state anti-NTRAPS laws to administratively expunge the document or file a Quiet Title action.

Frequently Asked Questions (FAQ)

Is an agreement binding if the company went into bankruptcy?

Federal bankruptcy courts have ruled that homeowners can challenge and void these agreements, particularly in states where state courts or legislatures have declared NTRAPS illegal.

Does a 40-year agreement transfer to my children if I pass away?

The contracts were drafted to purport to bind heirs and executors. However, state consumer protection laws and court rulings have widely invalidated these heir-binding clauses as against public policy.

Can a real estate broker pay me cash to list my house in the future?

Legitimate licensed real estate professionals compete on service, local market knowledge, and marketing expertise—they never pay upfront cash to lock consumers into multi-decade deed liens.
